Summary
In the years after the Universal Declaration of Human Rights (UDHR) had laid the foundation for a system of international human rights protection in 1947, priority was given first to the protection of refugees, and then to defining the rights of citizens. Concern for the human rights of migrants has been a more recent development. This paper reviews this changing situation, and asks whether it is yet possible to speak of an international migration protection in regime. It examines the international human rights treaty system, and the application of these treaties to migrants; it then reviews recent developments including the criminalisation of abusive migration – smuggling and trafficking – as offences under international law, and changes to international maritime law
